How to pay trademarks service fees

1.Brief description

According to 63th item of Trademark Law and 58th item of The Regulation on the Implementation of Trademark Law: applying for trademark, or dealing with other trademark affairs, service fees must be paid.

2.Ways to make payment

A.Handling directly

a.Cash. Applicants go to registration hall to make payment of service fees directly there.

b.Check. Applicants from Beijing, Tianjin, can handle trademark business by check

c.Bank draft. Applicants who are not from Beijing, can handle trademark business by bank draft.

Remarks: it takes 2-3 weekdays to make payment after submitting the bank draft, then the trademark business can be handled.

d.Bank M/T,T/T. Applicants who apply for trademark by post, can make payment by M/T, T/T. And they should post the copy of bank transfer receipt with the applicant form to Trademark Office or trademark revies and adjudication board.

Remarks: the names, of applicant, remitter, who raise trademark opposition, who want trademark reviewed, must be the same. And payment can’t be made in name of legal person, responsible person, operator.

B.Authorizing an agency

If applicant authorize an agency to handle trademark business, the service fees will be take off from the advance payment to agency and applicant don’t need to make payment to trademark office

a.Payment of Service Fees

Service fees of trademark belongs to fiscal revenue of state budget, and all the service fees will be turn over to central government.

Trademark agency should make payment of service fees according to different kinds of business. When making payment of service fees by bank transfer(M/T, T/T), trademark agency should handle this business in name that it filed in trademark office, and this business can’t be made in name of responsible or operator etc.. And the payment will be credited to financial system of trademark office in 3-4 weekdays. When application on line system is opened, the type of payment remains the same. And till now, other types of payment except for bank transfer.

There is no minimum limitation of the transfer amount, but the amount should be in accordance to the business, and if the payment is not enough, the application will not be accepted.

b.Unified Receipt and detailed list of cut payment

After checking the payment with application documents, the Notice of Acceptance will be issued by Tongda Trademark Service Center.

Trademark Office will settle account monthly and Unified Receipt will be printed then. After arranging, verifying, and revising, the receipt will be posted by registered letter, and agency will receive it in the middle of next month. The receipt is sending to trademark agency rather than trademark applicant.

At the end of every month, detailed specifications of cut payment, amount of the list and the unified receipt will be sent to trademark agency by email. When the Online Application system is opened, the unified receipt and list of detailed specifications of cut payment remain the same. And unified receipt will be listed as ¥800/trademark (online) and ¥80 cost of added item.

When receiving the unified receipt and e-list of detailed cut payment, trademark agency should check it in time, and contact financial department of trademark office if there is any questions or doubts. If not receive the email, trademark agency should contact Tongda Trademark Service Center (Tel:63219416/ 68010770) to resend the email. If the email address is not provided, please submit or email the email address file stamped by official seal to financial department of trademark office. And if the email address is changed, please submit or email the changed email address to financial department of trademark office, and the financial list of this or next month will be sent to the changed email address.

c.Type of Refundable Business

Trademark agency who wants to be refunded, should have original of Notice of not Approval, and those who have Notice of not Acceptance and Notice of Giving Up can’t be refunded.

d.Handling of Document without Payment

After daily checking payment, financial department of trademark office will issue Notice of not Acceptance to the application documents without payment. And the paper file won’t be returned, the data won’t be recovered, date and number of application won’t be kept, and if applicant want the trademark, he has to submit the application again.

The time difference between the financial balanced showed on online application system and that of financial department of trademark office is around one day. And if the electronic application is submitted online, but if the payment is not enough when checking the payment because the paper application has used up the advance payment, the application will be handled as not acceptance without payment. So trademark agency should make enough payment to avoid the not acceptance of not enough payment.

e.Balance Inquiry and Checking Account

Payment checking is the intermediate link of trademark verifying , and it can’t be counted the quantity of applications and the amount of money, and it can just reflect the settled business. And the balance shown by financial system can’t reflected available amount exactly. Trademark agency should check finance completely and exactly by themselves, to be accomplish business registration, turnover of adjustment and know the balance of advance payment in time. Trademark office doesn’t provide the service as balance inquiry.

Trademark agency can check account with financial department of trademark office annually, to check the transfer and use of advance payment. Trademark agency should prepare copy of transfer, unified receipt, account book and the detail lists and then make a call to financial department of trademark office or go to there.

f.To Handle the Procedure of Account Clearance

If trademark agency cancel or close the business, after handling relevant industrial and commercial procedures, it can apply for clear the advance payment account. Trademark agency should submit relevant documents to administration of quality and supervision of trademark office, only if passing the test, the account can be cleared.

Trademark agency should provide true, exact and complete financial information, and after verifying by financial department and according to the feedbacks from relevant departments, payment will be refunded and account will be cleared.

g.Registration of Changes of Names and Addresses of Trademark Agency

The name and address of that financial department of trademark office post the unified receipt are subject to the ones registered at trademark office, and if the name and address of trademark agency change, it should register at administration of quality and supervision of trademark office in time, and after registering ,the unified receipt will be posted to the changed ones. For the loss caused by untrue, inexact registered name, address or name and address changed but not registered in time, should be beard by trademark agency.

C. Note of receiving returned bill by post

a.Trademark agency should provide the following documents:

(1)Copy and original of business license(after annual inspection) of trademark agency(original one will be returned) or copy of business license(after annual inspection) with official seal of trademark agency.

(2)Valid introduction of letter from trademark agency

(3)Copy and original of receiver’s ID(original one will be returned)

(4)Letter of authorization if authorizing other person to receive it

(5)Copy and original of change certificate should be provided if name of trademark agency changed.

b.Enterprise should provide the following documents:

(1)Copy and original of business license of enterprise(after annual inspection, and original one will be returned), or copy of business license with official seal

(2)Valid introduction letter from enterprise

(3)Copy and original of receiver’s ID(original one will be returned)

(4)Copy and original of change certificate should be provided if name of enterprise changed

(5)Letter of authorization if authorizing other person to receive it

c.Natural person should provide the following documents:

(1)Copy and original of receiver’s ID(original one will be returned)

(2)Letter of authorization if authorizing other person to receive it

D. Attention:

(1)Any trademark business made payment by post won’t be accepted

(2)Only trademark opposition and trademark review can be made payment by bank M/T or T/T, no other business can be handled by transfer.
